CT Bar Association Supports Gun Control

An original Essay by Billboy Baggins
Today, the CT Law Tribune published an article stating that the CT Bar Assoc. is considering writing an amicus brief in support of U.S. District Judge Alfred Covello's dismissal of the lawsuit that had been filed by the Connecticut Citizen's Defense League and Coalition of Connecticut Sportsmen in opposition to S.B 1160, the most recent assault against the Constitution to come out of the CT legislature.  Following is my response:  (let's see how long the Trib lets my remarks stand)

This is so wrong; I don't know where to begin . . .

Let's start with the term "assault weapon".  This is a term dreamed up by the anti-gun extremist to raise fear in the minds of the low information crowd, who have no knowledge or experience with the lawful possession and use of firearms.  (Think about it; if someone hits you over the head with a bat, does the bat become an "assault bat" or is it still just a bat?  Or maybe we could call aluminum bats “assault bats” since they are unbreakable?)

Scary looking semi-automatic firearms like the ones that were banned by S.B. 1160 have been in common use at least since the early 60's.  (Eugene Stoner invented the M-16 in 1958)  Semi-automatic firearms in general have been in common use since the late 1800's.  https://en.wikipedia.org/wiki/Semi-automatic_firearm

Who gets the privilege of deciding what a "large-capacity ammunition magazine" is?  I'll bet it ain't me.  S.B. 1160 bans magazines that are capable of holding more than 10 rounds.  Yet, magazines that hold more than 10 rounds, including those used by civilians, police and military, are standard capacity magazines and have been in common use for a century.

When U.S. District Judge Alfred Covello dismissed the lawsuit filed by the CCDL and CCS, he said the ban on assault weapons and large-capacity ammunition magazines "does not effectively disarm individuals or substantially affect their ability to defend themselves".  If that were the case, why aren't police limited in the same way as the citizens?  After all, cops don't carry guns to defend YOU, they carry guns to defend themselves.  If you and I are not "substantially affected in our ability to defend ourselves" by a restricted magazine capacity, then it stands to reason that police would not be "substantially affected", either.

How would the judge know such a thing, anyway?  Has he ever been in a firefight?  Has he ever fired a gun?  Has he ever had his home invaded in the middle of the night by multiple assailants?  A single assailant?  No.  Covello earns a hefty salary from the bench and lives in a home with a sophisticated security system and has armed guards to protect him at work, unlike most of us.  He is an elitist, out of touch with the general citizenry.

Covello "reasoned" that "a wide variety of non-assault weapons" are still available for protection and hunting under the law.  He needs to look at the plain language of the Second Amendment; "A well regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms SHALL NOT BE INFRINGED,*" and the plain language of Article 1 Section 15 of the Connecticut Constitution, which reads, "Every citizen has a right to bear arms in defense of himself and the state."  You will notice, perhaps, that there is no mention in either of hunting or target shooting or limits to capacity or scarylookingness.

Covello admits 1160 burdens Second Amendment rights, but he claims it "is substantially related to the important government interest of public safety and crime control."  Gun control does not equate to crime control or public safety.  Last weekend in Chicago, where there are some of the most draconian gun laws in place, (remember McDonald?) there were ten people KILLED and forty-four wounded by criminals*** wielding firearms . . . in a single weekend!  http://gawker.com/5569299/chicagos-weekend-shooting-tally-10-dead-44-injured

Gun control laws do NOTHING to prevent crime and in fact it is evident that where gun control laws are most stringent, crime is highest.  Look at cities like Chicago, D.C., L.A., Philly, etc., all cities with draconian gun laws and controlled by Democrats, and you will see that crime rates (and poverty) are higher there than in places where gun laws are less restrictive.

Surely, we all understand the concept of "original intent"; let's step away and take a look at what our Founding Fathers wrote concerning the militia and the right of citizens to keep and bear arms.

On Feb. 20, 1788, Trench Coxe wrote in The Pennsylvania Gazette, "The powers of the sword are in the hands of the yeomanry of America from sixteen to sixty. The militia of these free commonwealths, entitled and accustomed to their arms, when compared with any possible army, must be tremendous and irresistible. Who are the militia? Are they not ourselves?  Congress has no power to disarm the militia. Their swords and every terrible implement of the soldier are the birthright of Americans. The unlimited power of the sword is not in the hands of either the federal or state governments but where, I trust in God, it will always remain, in the hands of the people."

George Mason said, "I ask, sir, what is the militia? It is the whole people, except for a few public officials."  16Jun1788, in Debates in Virginia Convention on Ratification of the Constitution, Elliot, Vol. 3

James Madison said, “A well regulated militia, composed of the body of the people, trained to arms, is the best and most natural defense of a free country ..." 8Jun1789, at page 434, Vol. I Annals of Congress

Lastly, though there are countless references from the Founders, are the words of Thomas Jefferson.  Jefferson said of the Second Amendment: ". . . what country can preserve its liberties, if its rulers are not warned . . . that this people preserve the spirit of resistance?   . . . The tree of liberty must be refreshed from time to time, with the blood of patriots and tyrants."  letter to William S. Smith in 1787,  (Jefferson, On Democracy 20, S. Padover ed., 1939)

Clearly, the authors intended the citizenry to be armed equally to, or nearly so, a standing army, including our own.  (See Scalia in Heller)  The right to bear arms has been referred to as our “liberty teeth”.

Let us now look at the unintended consequences of S.B. 1160.**  In a Hartford Courant column by Dan Haar, "Untold Thousands Flout Gun Registration Law", he writes, "No one has anything close to definitive figures, but the most conservative estimates place the number of unregistered assault weapons well above 50,000, and perhaps as high as 350,000."

Think about that; 50,000 to 350,000 of our fellow citizens and neighbors, as much as 10%, became instant felons on January 1, 2014 based solely on the type of property they own, not upon any specific criminal behavior.  How does the state intend to enforce this law, when tens, perhaps hundreds of thousands of people flaunt it?  How do you think these gun owners, not to mention those who complied with the law and those who don’t even own guns, will react if and when the state begins wide spread enforcement?  How will the citizenry in general react if and when the blood of otherwise innocent people, their families and law enforcement personnel is spilled for no other reason than the type of property they own and a refusal to comply with an unconstitutional law?  Is that a wise and prudent use of the taxpayer resources; to incarcerate or kill our fellow citizens over property?

Based on what I have read from around the country and my personal relationships with law enforcement personnel, there are plenty of cops who will not enforce unconstitutional laws.  After all, they are sworn to uphold and defend the Constitution.

In Wisconsin, Milwaukee County Sheriff David Clarke called proposals to seize firearms unconstitutional and warns of dire consequences if such plans are enacted.  "The reason is I don’t want to get shot, because I believe that if somebody tried to enforce something of that magnitude, (confiscation) you would see the second coming of an American Revolution, the likes of which would make the first revolution pale by comparison.”

Have you thought about the consequences of what could well escalate into a civil war?  I have, and the thought terrifies me to the extent that I will do everything in my power to prevent it.  The CBA should think twice before submitting an amicus in defense of S.B. 1160.

Then there are the lies necessary to promote such legislation as S.B. 1160.  Early in January of this year, Dannel 88 publicly stated that 1160 was a success, noting a drop in gun related crime since its passage.  This is an absolute lie.  In the first place, 1160 didn't go into effect until after the first of the year, and in the second place, those statistics are generally not available until some months after the end of the period in question.  Malloy fails to make mention that prior to the enactment of S.B. 1160 on 1Jan14, gun sales in Connecticut went through the roof and pistol permit applications have overwhelmed state police!  Assuming there really was a reduction in crime during that period, it is clearly not because of a restrictive, unconstitutional law, but because there are far more of our friends and neighbors bearing arms in defense of themselves, than there were prior to 14Dec12 and the criminals know it.

But the right to keep and bear arms is not absolute.  There are no absolutes in the Constitution; or are there?  Liberal Supreme Court Justice Hugo Black, stated, "There are 'absolutes' in our Bill of Rights, and they were put there on purpose by men who knew what words meant and meant their prohibitions to be 'absolutes.'”  (http://criminology.fsu.edu/faculty/gertz/hugoblack.htm)

Justice Black also wrote, "Our business is not to write laws to fit the day. Our task is to interpret the Constitution,"   (U.S. News & World Report, volume 63 (1967), page 38) I submit to you that, as it is the job of the courts to interpret the Constitution; it is the duty of legislatures to follow the Constitution and not to twist it to fit the passions of the day.

So what should the CBA do?  If the CBA is not willing to uphold and defend the Constitution of the United States and the Constitution of the State of Connecticut, it should butt out.  I can think of a Shakespearean quote that is apropos to the circumstance, but I dare not use it, lest some ignorant, alarmist, elitist coward take offense and my comments here, be banned.

PARTING SHOT:  It is a fool’s endeavor to think that this will stop with S.B. 1160.  The ultimate goal is the disarming of the American People.  Make no mistake about it.  Late last year, I heard a rumor that a state senator said there was a confiscation bill sitting in the drawer waiting for the this upcoming legislative session.  I called the office of Senator Jason Welch, of Bristol and his aid, through him, confirmed this for me.  Keep your powder dry!

BillBoy Baggins

*In Heller, Scalia wrote that the Second Amendment would have the same meaning if it read, "Because a well-regulated militia is necessary to the security of a free state, the right of the people to keep and bear arms shall not be infringed".

**Or are they REALLY unintended consequences?  Why would the post office or the National Park Service need to buy millions of rounds of hollow point ammo? (look it up)

Input Wanted on Right to Carry Laws in State Forests

A message from CCDL:
Governor Malloy is asking for a wide variety of input from the public on current regulations that affect Connecticut citizens in numerous ways.
It is currently a violation of state regulations to carry a firearm for personal protection in state parks and state forests. Pistol Permit holders go through training, background checks and pay a lot of money to obtain these permits. Since the Governor is asking for change recommendations, please take this opportunity by using the instructions below.
.The CCDL recommends that those in favor of 2nd Amendment rights do the following:
  • Fill out your Name, Email Address and Town.
  • field Regulations Agency drop-down, Select "Energy and Environmental Protection, Dept of"
  • field Regulation Subject Matter: enter Carrying handguns in State Forests and Parks
  • field Regulation Section Number: Enter 23-4-1(c) and 26-66-2
  • In the Comments enter the following text:
Please modify the State Agencies Regulations to allow individuals with valid Permits to Carry Pistols and Revolvers to carry a handgun for self defense while in CT State Parks and Forests. Specifically:

- Remove the prohibition on the 'carrying of firearms' in Section 23-4-1(c) of the Connecticut Agencies Regulations
- Add an exemption to 26-66-2 to allow the carrying of pistols and revolvers (including handguns using center-fire ammunition) for the purposes of self defense.

Letter to the Editor: Mayor Drew Anti 2nd Amendment: Gun Free Zones Signs at Middletown City Hall Don't Deter Crime

The essay reflects views and opinions not necessarily shared by the Insider staff, and is published as a courtesy to readers.
--------------------------------------------------------------------------------------------------------------------------------- I I recently visited our City Hall and noticed the large “gun free zone” signs displayed at every entrance. While I understand the intention, to say that we hope no-one inside is harmed by a dangerous weapon, what exactly does that sign do?

Does anyone honestly believe that a criminal, intent on hurting someone inside, is going to leave his or her gun in the car because they see the sign? Obviously not. It’s not as if it is a secure building - in fact I don’t even recall ever seeing a police officer or security guard there.

Meanwhile, law-abiding gun owners are left defenseless and stripped of their rights on the property that we, the taxpayers, pay for. I am sure that Mayor Drew, a proud member of Michael Bloomberg’s Mayors Against Illegal Guns, is in full support of the signs. It is far past time that our local and state government start employing logic before making such irrational decisions.

Filed Stamped Copy USDC CT Complaint (pdf)
Bridgeport, CT – Today, a widely-anticipated lawsuit was filed in U.S. District Court in Connecticut, challenging the constitutionality of the new firearms law that was passed hastily by the Connecticut legislature in response to the tragic shooting in Newtown by a disturbed individual. The lawsuit seeks immediate injunctive relief and a ruling declaring the new law unconstitutional under the Second Amendment of the U.S. Constitution. It alleges that Connecticut’s new firearms law is not only unconstitutional but dangerous, since it makes both citizens and law enforcement less safe by depriving citizens of firearms that are in common use throughout the country. The very firearms and design features banned by the new law are commonly used in part because of safety, accuracy and ease-of-use features that make them effective in the hands of citizens who must defend themselves and their families against criminals and the mentally ill who do not obey such laws.
Brought on behalf of individual gun owners, retailers, and citizen’s defense and sportsmen’s organizations, the lawsuit seeks to vindicate the constitutional rights of citizens who are harmed by the broad prohibitions and unworkable vagueness of the new law. The legal challenge focuses on Connecticut’s ban of more than 100 additional common firearms that the law now dubs “assault weapons” and on the ban of standard design features, including magazines that hold more than 10 round of ammunition, that provide improved safety, accuracy, and ease-of-use. The lawsuit also challenges the practical bans imposed by the new law on an even broader array of firearms due to the law’s vague language and interpretative confusion combined with severe criminal penalties.
Plaintiffs bringing the lawsuit include individuals such as an elderly widow who lives alone in a rural area where the emergency response time of a lone resident trooper serving the area is 45 minutes, a rabbi whose synagogue in the Bridgeport area has been broken into by intruders, a young professional woman whose efforts to defend herself are made more difficult by the loss of an arm due to cancer, among other individuals.
In addition, retailers whose businesses have been severely harmed by the law have joined the lawsuit, which was conceived and organized by fellow-plaintiff organizations the Connecticut Citizens Defense League, commonly known as CCDL, and the Coalition of Connecticut Sportsmen. Both organizational plaintiffs represent large numbers of Connecticut citizens whose rights to own the firearms of their choice for self-defense and other lawful purposes, such as sports shooting and hunting, have been harmed by the new prohibitions.
Despite the new law being called “An Act Concerning Gun Violence Prevention and Children’s Safety,” Connecticut’s new firearms law makes Connecticut citizens less safe. Among the individuals harmed by the law’s provisions are women, the elderly, and anyone of a smaller physical stature -- individuals who typically lack the strength to operate older style, heavier, or difficult to use firearms and yet who need to be able to protect themselves in challenging home-invasion and other self-defense situations.
CCDL’s President, Scott Wilson, who has seen his organization’s membership grow from 2,500 to 7,600 in just a few months, says “On behalf of our members and all of the plaintiffs, we wish to thank the National Rifle Association, whose vision and stalwart defense of citizens’ fundamental rights has helped make this important legal challenge possible.” Wilson says, “Connecticut’s new gun ban violates Second Amendment rights by depriving law-abiding citizens of firearms that are in common use throughout the country precisely because of their known effectiveness in the protection of citizens, their families, and homes. Criminals and the mentally ill will not abide by this terrible law, which means it has the perverse effect of actually making citizens and law enforcement officers less safe.”
Bob Crook, Executive Director of the Coalition of Connecticut Sportsmen, says, “This law will do nothing to prevent a tragedy or solve the problem of crime committed with guns. Instead of violating constitutional rights, we need to get serious about addressing violence and mental illness.” He continued, “Two recent independent studies by Pew and the federal government have just revealed that gun homicides are down almost 40% and general crime involving guns has dropped a whopping 70% since 1993, which corresponds with the elimination of the federal assault weapons ban. In contrast, the few areas of the country where gun crimes have increased dramatically are the very places where local or state governments have banned or severely restricted gun ownership by law-abiding citizens.”

Guest Blog: Greetings Patriots from Palin Smith Conservative Roundup

Below is a roundup of Conservative events being held this week. Complied and submitted by Palin Smith. Opinions are that of Palin Smith and do not necessarily reflect that of Insider Staff.
-------------------------------------------------------------------------------------------------------------------------------------
GREETINGS PATRIOTS
Wall Street celebrated this morning when the Dow Jones Industrial Average broke above 15,000 for the first time. With reports of 165,000 new jobs created in April and a drop in the unemployment rate to 7.5%, the low-information voters are mesmerized in math la-la-land. However, more unintended consequences of Obamacare over-shadowed the jubilation. The equivalent of 500,000 jobs lost must also be reported. Businesses are cutting back people to part time employees.
-----------------------------------------------------------------------------
Two nights ago in Tolland the Republican Party made its choice, Samuel Belsito, to run for state rep. in the 53rd district, comprising the towns of Tolland, Willington and Ashford. A special election will be conducted on June 11, 2013 to replace former Rep. Brian Hurlburt, who took a job with the US Agriculture Department, another useless agency.
This 5-week special election is significant because it will be the first time the huge influx of 2A supporters and defenders will have an opportunity to flex their new political muscles. Mr. Belsito will meet the public very soon. If you want to find out where he stands on guns or any other issue, we will publish his early public appearances schedule. Help snatch a seat away from the majority in Hartford. You don’t have to live in the district to volunteer.
Last night the Democrats chose their candidate for the 53rd. Soon you will have a clear choice.
-------------------------------------------------------------------------------------------
The weekly meeting of the Connecticut Restoration Coalition http://ct-rc.org/ is scheduled for 5 PM at KING 33 tomorrow in Southington. Last week Robert Spencer of Jihad Watch, http://www.jihadwatch.org/ , delivered a short lecture and led a Q & A for twenty more minutes. This link will take you to the full lecture and a couple of questions.
--------------------------------------------------------------------------------------
The host of our meetings, KING 33, is seeking permission to expand its professional capacity into an adjacent building. Chris Fields has asked for support at Tuesday’s Southington Planning & Zoning meeting. More information at this link.
---------------------------------------------------------------------------------------
Several patriot groups are readying challenges to Connecticut’s new gun law. Please donate to CCDL http://www.ccdl.us/ and DAFR http://www.dafr.org/
If you’ve got “stuff” you’ve wanted to part with but never had the gumption to do it, perhaps now is the time. CCDL has set up a sort of tag sale on Facebook. Let your imagination run free in inventing other ways to recover cash to donate to the court challenge of a very bad law. Get involved now and stay involved right through the 2014 election.
-------------------------------------------------------------------------
5th District Rep. Elizabeth Esty plans to meet her constituents tomorrow afternoon in Kent.
WHAT: Congress on Your Corner in Kent
WHEN: Saturday, May 4 from 2:00 to 3:00 PM
WHERE: Kent Memorial Library, 32 N. Main St, Kent

GREETINGS PATRIOTS

If you want to attend the CCDL Gun Rights Rally at the State Capitol Saturday at Noon and don’t have a ride, be advised there are several buses reserving seats, and car pools in the process of being formed. To find a ride or volunteer to drive a full vehicle, follow this link, which is also the Face Book invite to the event.

And there still is plenty of time to print out the PDF of the flyer and post it around your town. Be sure to go back and remove them next week.

Last Saturday at the Connecticut Restoration Coalition  http://ct-rc.org/   meeting at KING 33 in Southington, the sister of the baker who created the cake “seen ‘round the world” attended for the first time. This video tells her story.

THE PRESCOTT BUSH DINNER MAY 20 IN STAMFORD.
The Connecticut Republican Party is set to present an award to Senate Minority Leader, John McKinney, at the dinner. Wisconsin Governor Scott Walker has been booked as the keynote speaker.
If you remember, conservative Tea Party favorite, Walker, handily won a costly recall election last year. This is what can happen in a formerly “blue” state when a good conservative takes the helm of the Republican Party. Walker brought the establishment Republicans together with the Tea Party Conservatives in a stunning victory.
Walker had attracted the ire of unions and national Democrats after transforming Wisconsin into a right to work state. Many Tea Party friends from Connecticut traveled to Wisconsin at their own expense to aid in that campaign.
There is an opportunity to unite established Republicans in Connecticut with conservatives and Tea Party Patriots. Many RTC Chairmen, including those in Enfield and Woodbury, have voiced their intentions to boycott the Prescott Bush Dinner over the announced award being presented to Sen. John McKinney. Most Republicans are highly disappointed with McKinney’s actions during the gun control debate. His vote was observed as trampling on the 2nd Amendment!
If you resent the Senator’s apparent lapse of judgment, you can make your opinion heard in the following manner:
1. Call Chairman Jerry Labriola at the GOP HQ      860-422-8211
2. Call Governor Walker’s office in Madison          608-266-1212
You can call your town RTC chair to find his or her position as well
Faxes and emails are also appropriate.
-------------------------------------------------------------------------------------------------------------
We do not intend to do damage to the CT Republican Party. The Party has been adept at self-infliction. Perhaps we can learn from this moment in time to follow Governor Walker’s leadership. As a gesture to unite the Party with the people.
I remember a scene from the Academy Award winning movie, BRAVEHEART.
Let us resolve that the Connecticut Republican Party will never again be subjugated to the whims of weak leadership or misguided bi-partisanship!

Guest Blog: Changing Neighborhoods, an Essay

Below is a essay by Middletown resident William Boylan. All opinions expressed are that of the author and not necessarily that of the Insider staff.
-----------------------------------------------------------------------------------------
Changing Neighborhoods, an Essay. By William Boylan

Alex Haley;s book, “A Different Kind of Christmas”, was given to me as suggested reading; something lighter than the usual reading fare to distract from the enormous problems our society faces at a turbulent time, in a turbulent world.

On page three, a phrase caught my eye and stuck in my mind as relevant,

“. . . changing neighborhoods is not always a solution to problems.”
You see, for the longest time the idea of fleeing my adopted state of Connecticut has lingered in the back of my mind.  Preventing it were finances, something not insurmountable but problematic and that Linda’s parents were still here and that she would never be able to leave them.  (can’t fault her for that)  Though I have some close friends, my family here is estranged, therefore I have no heavy anchor and so what other reason is there to remain?

Prodding me to leave is frustration and dismay over the political climate and the steady erosion of liberties by a legislature that ignores the Constitution.  Rampant taxation and debt, a populous willing to sacrifice liberty for a false sense of security, social and ethical decline, a shrinking income and an ever increasing cost of living are major contributors to my desire for a change of scenery.

Not being one to run from adversity though, something about the idea of fleeing just doesn’t rest well in my gut.
In junior high I was bullied until I got fed up one day and fought back . . . and won.  I was never picked on, again.  In fact, I earned a measure of respect from fellow classmates.

In high school, someone stole a watch my parents gave me for Christmas.  At 17, I filed a suit in small claims court . . . and won.

As an adult, I battled several unscrupulous landlords . . . and won.

Once, a prosecutor who didn’t like my attitude, brought me up on non-support charges, even though I was current and making regular payments to my ex.  She did this without standing.  My ex never filed a complaint for non-support, nor did the prosecutor ever talk to her about it.  I fought back . . . and won.  (I believe it cost the prosecutor her job.)

It just ain’t in me Irish blood to back down from a fight!

But, the fight we face today is not about me.  It goes far beyond my narrow, personal interest.  What we face today, is a battle for the future of our state and nation, and indeed the world.  If Liberty falls in America, the world will fall into the abyss with her.  We are certainly the last bastion of hope (outside Christ) for the world.  If Connecticut falls, so surely will another state fall, then another.  Before long, there may be nowhere left to run!  What of our children, grand children and generations yet unborn?  Our posterity has a stake in this, too.  What will be the legacy we leave unto them; liberty or tyranny?

What of the oath we took and renew each week at the Connecticut Restoration Coalition meetings; the oath to support and defend the Constitution against all enemies, foreign and domestic; the pledge of our lives, our fortunes, our sacred honor, so help us God?  Do we fulfill that oath by fleeing?  Do we truly mean what we say or are our words hollow platitudes?

Maybe I think too much, but what of the Founders, the original American Patriots?  What of them?  What of their sacrifices?  What of their pledge of their fortunes, their lives, and their sacred honor?  They truly meant it and lived it.  Many lost everything they had; money, property, family, life.  What would they think of us if they could look down and see what we are doing, today?  Do we honor their sacrifices by running or do we follow in their footsteps and live as we speak?  Or, are we simply paying lip service to a romantic notion?

Our mettle is about to be tested; do we pass the test, or do we fail?

“. . . changing neighborhoods is not always a solution to problems.”

Letter to the Editor: Passage of Ct Gun Control Bill is Injustice

Last week the Insider published a series of comments from our facebook page noting citizens' reactions to the recently passed gun control legislation by the state of Connecticut.

Below is a letter to the editor on the topic, letters to the editor are published as a courtesy to readers, and opinions expressed/ claims made may or may not be shared by Middletown Insider staff.

What are your thoughts?

As a USMC vet with two combat deployments, I have never been more ashamed to be a part of this nation. Our founding fathers would cry at the abject bastardization of the principles they put in place to protect us from just this sort of injustice.

Well, it looks like, in the next few days, the non-emergency Emergency Certification (E-cert) bill will be placed before you, for a vote.
What are you going to do?
We, the people, are hearing all kinds of things, about this non-emergency E-Cert bill. It is quite alarming to those that believe in the Rule of Law, 2nd Amendment Rights, oaths taken, and their personal safety. I am sure many of you are also concerned.
I realize the situation you have found yourself in is not a comfortable one. It has been made harder for you, due to your current caucus leaders who are working behind closed doors crafting a “do something” piece of legislation. A piece of legislation…based on the information floating out there in the public realm, that the majority of your constituents reject.
Because we do not know the final non-emergency E-cert bill, we can only speculate on its contents…something that will currently get none of us anywhere.
So I am writing to you, to offer up some guidelines to help you determine if you should vote yes or no.
There are three components to this non-emergency E-cert bill: School Safety, Mental Health, and Gun control (let’s be clear, from what we have seen proposed over the last three months, it is not about gun violence).
1. The first thing that you should be demanding, of your respective caucus leaders, is that the bill be broken down into three separate bills. There are three very different issues and many different proposals. If they refuse to do this for you, then you need to vote NO on the whole package.
2. Next, you need to demand that you be able to offer up, and have votes taken, on amendments to the bill. You, as our elected officials have every right to have input into every piece of legislation and remove anything that was put in to “sweeten” the pot. Just because they have decided to label this bill an E-cert bill, when it clearly is not, should not allow them to take your right to fulfill your duty and role in the General assembly. If they refuse, then you need to vote NO on the whole package.
3. Lastly, you also should demand that you be able to take this proposed non-emergency E-cert bill back to your respective districts and speak with your constituents. If they refuse, then you need to vote NO on the whole package.
Prior to voting on this non-emergency E-cert bill I ask that you ask yourself these questions:
1. Is this Constitutional?
A. I understand that many are using Justice Scalia’s words, from DC vs. Heller, to say that you do have the right to limit the 2nd Amendment via what type of weapons can be banned. Unfortunately they ignore, deny, or misunderstand what he has said:
“[United States v.] Miller’s holding that the sorts of weapons protected are those “in common use at the time” finds support in the historical tradition of prohibiting the carrying of dangerous and unusual weapons.”
